COMMERCIAL DRIVER CELL PHONE BAN

The Department of Transportation (DOT), Federal Motor Carrier Safety Administration (FMCSA) and Pipeline Hazardous Materials Safety Administration (PHMSA) prohibits motor carriers from requiring or allowing drivers to use mobile, hand-held cellular telephones while operating a Commercial Motor Vehicle (CMV).

ABOUT THE RULE

  • Prohibits motor carriers from requiring allowing drivers to use hand-held mobile telephones while operating a CMV to:
    • Hold a mobile telephone to conduct a voice communications
    • Dial a mobile telephone by pressing more than a single button
    • Reach for a mobile phone in an unacceptable or unsafe manner
  • Rule applies to CMVs with a GVW of 10,001 pounds or more, designed or used to transport more than 15 passengers, not for compensation, transporting any quantity of hazardous materials requiring placards to be displayed on the vehicle.
  • Violations could result in driver disqualifications for CMV drivers holding a CDL license, up to a $2,750 fine per driver and up to $11,000 fine for employers.
