US DOT Issues Final Rule Banning Cell Phone Use by CMV Drivers
Final rule restricts CMV drivers from using a hand-held mobile/cellular telephone while operating a commercial truck or bus.
ABOUT THE RULE
The Department of Transportation (DOT), Federal Motor Carrier Safety Administration (FMCSA) and Pipeline Hazardous Materials Safety Administration (PHMSA) issued a final rule prohibiting motor carriers from requiring or allowing drivers/operators to use mobile, hand-held cellular telephones while driving a Commercial Motor Vehicle (CMV).
The final rule went into effect on December 23rd, 2011 and restricts CMV drivers from:
- holding a mobile telephone to conduct a voice communication
- dialing a mobile telephone by pressing more than a single button
- reaching for a mobile phone in an unacceptable and unsafe manner
The rule also restricts a driver’s use of the push-to-talk feature on mobile / cellular phones. Beginning January 3rd, 2012, any driver who needs to communicate by mobile phone while operating a CMV must use a compliant mobile telephone that can be operated in compliance with this rule. Non-compliance may result in new driver disqualifications for CMV drivers holding a Commercial Driver’s License (CDL) as well as fines for the driver and employer. The term “mobile telephone” does not include two-way mobile radios and/or portable radios.
